Privacy Policy

KICKSITE Privacy Policy

The privacy of your data is important to us.  While KICKSITE processes your data, we’ll only ever access your account to help you with a problem or resolve a software bug.  We’ll never open any uploaded files unless you ask us to.  We log access to all accounts by IP address, browser and operating system so we can verify unauthorized access (for as long as the logs are kept).

Identity & Access

When you sign up for KICKSITE, we ask for your name, company name, email address, billing address, and credit card information, so we can send invoices, updates, and other essential information.  When you invite a new user, we ask for their name and email address so we can verify their access to your account.  We’ll never sell your personal info to third parties, and we won’t use your name or company in marketing statements unless you’ve publicly shared the information or expressly provided us permission.

When you contact KICKSITE with a question or to ask for help, we may access your account to assist with our response and we’ll keep that correspondence, and the email address, for future reference.  Some features allow users to provide KICKSITE with content such as images, screen recordings and and written comments. Such content is retained in your account for as long as your account is active and a reasonable period thereafter in case you decide to re-activate the services. When you browse our marketing pages and use KICKSITE, we aggregate general browsing data for statistical purposes only (like for measuring conversion rates, to test new designs, and to determine which features are utilized the most).  Users of KICKSITE can store any type of information in KICKSITE, but KICKSITE does not share that data or generally know what type of data you or other users are storing.  The data is only used by the account owner and invited users as they intend to use it.

The only times we’ll ever share your info:

  • To provide products or services you’ve requested, with your permission.
  • To investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Service, or as otherwise required by law.
  • If KICKSITE is acquired by or merged with another company, besides our parent company,we’ll notify you well before any info about you is transferred and becomes subject to a different privacy policy.

You always have the right to access the personal information we store about you.  You can review the personal information you provide to us and make any desired changes to the information, or to the settings for your KICKSITE account, at any time by logging into your account on the website and editing the information on your Profile page.  You may also contact us at support@kicksite.net to make any such request.

Law Enforcement

While we may be required to disclose your personal information in response to a lawful request by public authorities, including to meet national security or law enforcement requirements, KICKSITE won’t otherwise hand your data over to law enforcement unless a court order says we have to.  And unless we’re legally prevented from it, we’ll always inform you when such requests are made.

Cookies

In order to improve our services and the website, and provide more convenient, relevant experiences to you, we and our vendors may use “cookies”, “web beacons”, and similar devices to track your activities.

KICKSITE also contains embedded ‘share’ buttons to enable Users to share content through social networks, such as Facebook and Twitter.  These sites may set a cookie when you are logged in to their service.  We do not control the setting of cookies from these websites.  Please check the third-party websites for more information about their cookies and how to manage them.

Encryption

All data is encrypted via SSL/TLS when transmitted from our servers to your browser.  The database backups are also encrypted.

Third Parties

KICKSITE uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to provide you with our services.  A current list of vendors is available upon request.

Deleted Data

Because we frequently have former clients return to KICKSITE, should you cancel your account, we keep your data on our servers in case you decide to reinstate your account.  Should you prefer to have your data purged, you can specifically request to have your data deleted by contacting us at support@kicksite.net.

Breach Notifications

KICKSITE has an internal, documented Breach Notification Process.  Externally, we will be updating our Terms of Service to include a more detailed description of our notification protocol in the event of a data breach.

GDPR Readiness

The EU General Data Protection Regulation (GDPR) is a new comprehensive data protection law designed to strengthen and unify data protection for individuals within the EU, essentially giving EU residents and citizens more control over their personal data.  The GDPR takes effect on May 25, 2018.

Any organization with a presence in an EU country or any company that processes personal data of EU residents and citizens will be impacted by this regulation.  Any business that processes the personal data of EU citizens and residents must comply with the GDPR.

KICKSITE has reorganized our Privacy Policy to ensure that we, and our users, are able to honor the rights of European customers over their personal data.

KICKSITE is creating tools and processes to assist customers with fielding requests from their clients who ask to remove their information from KICKSITE databases.  Identified consumer data will be removed if requested by the consumer and approved by you, the customer.

As a customer (‘data controller’ under GDPR terminology), you are responsible for ensuring compliance with the key requirements of the GDPR.  This includes notifying individuals of how you handle their personal information, obtaining their consent where appropriate, addressing their requests for access to their information, etc.

KICKSITE will provide you with assistance in meeting those requirements where possible and appropriate.  For example, KICKSITE may provide you with tools and processes to assist you in honoring individuals’ requests, including requests for deletion, data portability, access, and rectification.  However, please note that you remain responsible for compliance with these requirements.

Changes & Questions
